We would like to thank the Planning and Zoning Commission for its unanimous decision to deny a permit for a new cell tower to be located on the grounds of Trinity Heights United Methodist Church at 3600 N. 4th St. We believe the commission’s decision upholds the letter and spirit of zoning code requirements relating to telecommunications facilities in residential areas.
We appreciate that the commission listened carefully and acknowledged neighborhood concerns about the public safety and welfare of constructing such a facility adjacent to the high pressure Kinder Morgan natural gas pipeline, with homes, a child care facility, and the National Forest nearby. It was clear that the applicant had not vetted their proposal with either Kinder Morgan or the Forest Service.
Also, commissioners correctly recognized that the applicant did not demonstrate a compelling need for the new facility and did not meet code requirements for assessing and attempting to secure a “favored” site for a cell tower before applying for a “dis-favored” residential site.
