The city of Flagstaff is close to suing a Los Angeles-based insurance company over a performance bond posted by the former developers of the Presidio of the Pines subdivision.

City records indicate Acting City Attorney Michelle D'Andrea has recommended that the city file a lawsuit against American Contractors Indemnity Company in order to tap a $1.4 million bond set aside for landscaping at the project.

ACIC has acknowledged to the city that it is liable for the bond but is now refusing to pay on the bond or construct the landscaping, according to city officials.
